1. Acceptance of Terms

By downloading, installing, or using Weally ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Weally is a privacy-first sobriety and habit-change tracking application. The App provides tools for:

• Tracking sobriety progress and daily check-ins
• Logging cravings and identifying triggers
• Guided CBT (Cognitive Behavioral Therapy) thought records
• Journaling with mood and energy tracking
• Milestone celebrations
• Emergency breathing exercises and crisis resource access
• Community peer support (when available)
• Data export for sharing with healthcare providers

3. Not Medical Advice

Weally is not a medical device, therapy service, or substitute for professional treatment. The App does not provide medical advice, diagnosis, or treatment. The CBT thought record feature is a self-help tool based on cognitive behavioral therapy principles, but it is not therapy.

If you are experiencing a medical emergency, substance withdrawal symptoms, or suicidal thoughts, please contact emergency services or a qualified healthcare professional immediately.

Always consult with a qualified healthcare provider before making decisions about your addiction recovery or mental health treatment.

4. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 18, you should review these Terms with a parent or guardian.

5. Your Account & Data

Weally does not require an account to use. Your recovery data is stored locally on your device and encrypted with AES-256 encryption. We cannot access, recover, or restore your data. You are solely responsible for maintaining the security of your device.

If you delete the App or your device data, your recovery data is permanently lost. We recommend using the in-app export feature to back up important data.

6. Subscriptions & Payments

Free tier: Core tracking features for up to 2 addictions are available at no cost, with no time limit.

Premium subscription: Additional features are available through a paid subscription (monthly or annual). Subscriptions are processed through the Apple App Store or Google Play Store.

• Payment is charged to your App Store or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage and cancel subscriptions in your device's subscription settings (App Store or Google Play)
• No refunds will be provided for partial billing periods, but you retain access until the end of your current period
• Free trial: If offered, the free trial converts to a paid subscription unless cancelled before the trial ends

7. Community Guidelines

If you use community features, you agree to:

• Be respectful. This is a recovery space. Treat others with empathy and kindness.
• No harassment, bullying, or hate speech. Zero tolerance.
• No promotion of substance use. Do not glorify, encourage, or provide instructions for substance use.
• No medical advice. Share your experience, but don't diagnose or prescribe.
• No solicitation. No selling, advertising, or recruiting.
• Protect privacy. Do not share others' personal information or recovery details outside the community.
• Flag crisis posts. If you see someone in immediate danger, use the crisis flag feature.

We reserve the right to moderate, remove content, or restrict access for violations. Severe violations (threats, illegal content, predatory behavior) result in immediate permanent removal.

8. Intellectual Property

The App, its design, features, and content are owned by Weally and protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" without warranties of any kind
• We are not liable for any damages arising from your use of the App, including but not limited to relapse, health outcomes, data loss, or decisions made based on App content
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Weally from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your community posts.

11. Termination

You may stop using the App at any time by uninstalling it. We may terminate or suspend your access to community features if you violate these Terms. Termination does not affect data stored locally on your device.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be resolved in the courts of Australia.
